Minnesota — Collection Agency (Individual) Bond

This Minnesota collection agency option is for an individual proprietor using Commerce's individual bond form. It is not an employee debt collector's registration. Match the proprietor's legal name and office to the agency application before ordering or signing.

What this bond does

The individual form secures the proprietor's compliance with sections 332.31 through 332.45 and other legal obligations arising from the conduct of the collection agency. Its condition extends beyond accounting for money collected for clients.

Who needs it
Individual proprietors applying for or maintaining a Minnesota collection agency license. A corporation, LLC or partnership uses its corresponding Commerce form; calling a business owner an individual does not change the business's legal organization.
Who it protects
The bond runs to the Minnesota Department of Commerce for the State and all people damaged by a breach of the specified statutes or other agency-related legal obligations. Principal and surety are jointly and severally bound. The Commissioner and a damaged person have an action on the bond, subject to its aggregate limit.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details

Commerce requires at least $50,000, with an additional $5,000 for each $100,000 received from Minnesota debtors during the preceding calendar year, less commissions earned on those collections, up to $100,000. Use the Department's worksheet and required amount. The relevant figures are not simply the firm's nationwide receipts.

The individual form requires the proprietor's signature and acknowledgment as owner, along with the surety attorney-in-fact's signature, acknowledgment and power of attorney. Arrange the required notarizations and match the principal name and office to the application. An employee collector should not sign as the agency proprietor.

This is a continuing obligation. Its aggregate liability does not increase with the number of claims or years in force. The surety's cancellation takes effect 30 days after notice is sent to the obligee, without removing liability already incurred. The form requires the surety to notify the Commissioner before paying a claim.

Submit the agency application through Sircon and upload the original executed individual bond. The financial statement, organization or assumed-name documentation and other application requirements remain separate. Once licensed, the agency submits its individual collectors' registrations; their registrations do not replace the proprietor's agency license.

Purchase Now opens Propeller's Minnesota individual collection agency application in a new tab. Have the proprietor's legal name, office, required sum and Commerce request ready. Check that the issued document is the individual-proprietorship form, complete its execution and upload it through Sircon. The June 30 agency-license renewal is a separate requirement, not something checkout completes.

Have these ready

  2. Match the proprietor's legal name, any assumed name and office to the agency application.
  3. Gather prior-calendar-year Minnesota debtor receipts and earned commissions for Commerce's amount worksheet.
  4. Arrange owner and surety acknowledgments, power of attorney and upload of the original executed form through Sircon.

Questions about this bond

Is this the bond for an individual employee debt collector?

No. The individual bond form is for the proprietor of the collection agency. The licensed agency separately submits employee collectors' registrations to Commerce.

Can an LLC owner use the individual form?

The form follows the agency's legal organization. Commerce publishes a separate corporation/LLC form. An LLC does not become an individual proprietorship because one person owns it.

Does the liability limit start over each June?

No. The individual form describes continuing aggregate liability regardless of claims or years in force. Review the required amount against the prior year's Minnesota collections and commissions separately from renewing the agency license.
