Nebraska — Process Server Bond

Nebraska’s process server statute calls for a $15,000 corporate surety bond where its private-service provisions apply. One bond can serve multiple state courts, but each court clerk needs evidence of it. Apply through The Southern Agency with those court details ready.

What this bond does

The undertaking backs faithful and true performance of process-serving duties under Section 25-507. It is not a statewide license issued by buying a bond.

Who needs it
Eligible individuals age 21 or older, corporations, partnerships and LLCs using Section 25-507 in counties without a contracted constable under Section 25-2229.
Who it protects
The statutory condition is faithful performance by the person or entity furnishing the bond. Qualification also depends on independence from the action: the server cannot be a party, related to a party, interested in the action or a disqualified county official whose duties include service.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Confirm the statute applies in the service county

Section 25-507 ties these powers to counties without a person contracted as a constable under Section 25-2229. Do not assume the same private-service route applies in every county just because one bond can be used across state courts.

Keep the proposed person or entity’s identity, the service county and court instructions together. A business principal is permitted by the statute, but the named applicant still has to satisfy the statutory conditions.

One bond, evidence for each court

The statute expressly says no more than one bond is required for service in Nebraska state courts under this provision. It separately requires evidence for the clerk of each court where the server executes process or orders, with proof of service shown by affidavit.

Questions about this bond

Must I buy another bond for each court?

Section 25-507 says no more than one bond is required under this provision. You still must provide evidence of it to the clerk of every court in which you execute service or orders.

Can a business furnish the bond?

The statute permits corporations, partnerships and LLCs as well as qualifying individuals. Match the actual person or entity exercising the statutory powers, not an unrelated trade name.

Does purchase authorize service in every county?

No. The statute’s private-service powers are tied to counties without the specified contracted constable and to its other qualifications. Confirm the applicable route before serving.
